Welcome to www.greathomestaysofindia.com (“we”, “our”, or “us”). By accessing or using our website www.greathomestaysofindia.com and the services offered through it (collectively, the “Platform”), you agree to be bound by these Terms and Conditions (“Terms”).

Please read them carefully before proceeding with any bookings or listings.

1. Definitions

  • Guest: A user who browses, searches or books a property on our platform.
  • Host: Property owners who list their property and booking details.
  • User: Any individual or entity using the Platform, including both guests and hosts.
  • Property: The Homestays, Bed and Breakfasts, Guest Houses, Lodges, Tourist Homes, Farm Stays, Tented Accommodations, Houseboats, Inns, Motels, Rest Houses, Guest Houses, Cottages, Chalets etc. or accommodation listed by the Host for short-term rental.

2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract to use the Platform. By using the Platform, you confirm that you meet these requirements.

3. Account Registration

You may access most areas of the Website without registering your details with us. Certain areas of the Website may only be open and/or function if you verify your credentials or register with us. You agree to provide accurate, complete, and up-to-date information and to keep your login credentials secure. You are responsible for all activities under your account.

4. Booking and Payment

  • Guests can browse listings and make bookings directly through the Platform.
  • Payments must be made in full at the time of booking through our authorized payment gateway or to the respective properties as per there payment terms and procedure.
  • Prices displayed may not include applicable service charges and taxes, unless otherwise stated.
  • Booking communication can be sent by email, WhatsApp or displayed on your dashboard.

5. Cancellations and Refunds

For Guests:

  • www.greathomestaysofindia.com does not collect any money from the guests for itself or on behalf of its listed properties. Properties are encouraged to list their payment acceptance options and policies in their respective listings.
  • Cancellations can be made directly with the property booked. Refunds will also be done by the booked property as per their “Refund Policy”.
  • www.greathomestaysofindia.com cannot be held liable for any payment made by the Guests to the listed Properties for any reason whatsoever.

For Hosts:

  • Hosts must honour confirmed bookings. Repeated cancellations may result in penalties or account suspension. Payments made to GHSOI Pvt. Ltd. are non-refundable.

6. Host Obligations

  • Hosts must provide accurate and complete information about their property.
  • Hosts are responsible for maintaining a clean, safe, and compliant space.
  • Hosts must not list properties they are not legally allowed to rent.
  • Any local laws, taxes, or licences are the Host's responsibility.

7. Guest Obligations

  • Guests must treat properties and hosts with respect.
  • Any damages caused by the Guest may be charged to them.
  • Illegal or disruptive behaviour may result in cancellation of the booking and removal from the Property.

8. Prohibited Activities

Users may not:

  • Post false or misleading information.
  • Use the Platform for illegal or unauthorized purposes.
  • Violate any applicable local, state, or central laws.
  • Attempt to bypass payment systems or engage in direct booking outside the Platform.

9. Intellectual Property

All content on the Platform—including logos, designs, text, images, and software—is the property of www.greathomestaysofindia.com or its licensors. You may not copy, modify, or distribute any part of the Platform without written consent.

10. Limitation of Liability

We act only as an intermediary between Hosts and Guests. We do not own, operate, or manage any properties listed.

To the maximum extent permitted by Indian law, we are not liable for:

  • Any property-related issues (e.g., hygiene, safety, inaccessibility)
  • Loss or damage incurred during stays
  • Cancellations by Hosts or Guests
  • Any indirect, incidental, or consequential damages

11. Indemnification

You agree to indemnify and hold harmless GHSOI Pvt. Ltd., the owners of www.greathomestaysofindia.com, its affiliates, officers, and employees from any claims, liabilities, or expenses arising from your use of the Platform or violation of these Terms.

12. Privacy

Our handling of your personal data is governed by our [Privacy Policy – insert link], in compliance with applicable Indian data protection laws.

13. Dispute Resolution

Any disputes shall be first attempted to be resolved amicably. If unresolved, they shall be subject to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in New Delhi, India. The decision of the arbitrator shall be final and binding.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Courts in New Delhi shall have exclusive jurisdiction.

15. Termination

We reserve the right to suspend or terminate your account or access to the Platform at our discretion, without notice, for any violation of these Terms or suspected fraudulent activity.

16. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after such changes constitutes your acceptance of the revised Terms.

18. Insurance and Liability Waiver

a. Guest Insurance

We do not provide insurance coverage for guests. We recommend that guests obtain travel and health insurance from third-party providers to cover cancellations, accidents, or other incidents during their stay.

b. Host Insurance

Hosts are solely responsible for ensuring that they have appropriate insurance coverage (e.g., homeowner’s or rental insurance) that covers short-term stays and third-party liability. We are not liable for any loss or damage to Host property or injury to guests.

c. Waiver of Liability

By using the Platform, you agree that GHSOI Pvt. Ltd., the owners of www.greathomestaysofindia.com shall not be held liable for:

  • Accidents, thefts, injuries, or property damage occurring during a stay.
  • Any losses arising from force majeure events (e.g., natural disasters, political unrest).
  • Disputes between Hosts and Guests.

19. Host Verification Standards

To ensure trust and safety on our Platform, hosts must:

  • Verify identity by submitting a valid government-issued photo ID (Aadhaar, PAN, Passport, etc.).
  • Provide proof of property ownership or authorization to rent (e.g., utility bill, property deed, rental agreement).
  • Maintain updated contact details for emergency and guest communication.
  • Agree to periodic inspections (virtual or physical) as deemed necessary by us.
  • Ensure that the licence to use the Property for short-term rentals is renewed on time from the respective government department/s

Non-compliance may lead to suspension or permanent removal of listings, even if paid for.

20. Mobile App Terms

These additional terms apply if you access the Platform via our official mobile app.

a. App Store Terms

You must also comply with the terms of the relevant app store (Google Play, Apple App Store) from which you downloaded the app. We are not responsible for their performance, availability, or any third-party services accessed through the app.

b. Permissions

The app may request access to your device features (e.g., location, camera, storage) solely to enhance user experience and for safety purposes (e.g., location sharing during check-in). You can manage these permissions through your device settings.

c. Updates and Availability

We reserve the right to modify or discontinue app features at any time. We are not liable for unavailability due to technical reasons or third-party outages.

21. Force Majeure

We shall not be liable for any delay or failure to perform obligations under these Terms if the delay or failure results from events beyond our reasonable control, including but not limited to natural disasters, war, acts of government, internet or power outages, strikes, or pandemics.

22. Entire Agreement

These Terms, along with our Privacy Policy and any additional guidelines posted on the Platform, constitute the entire agreement between you and GHSOI Pvt. Ltd., the owners of www.greathomestaysofindia.com regarding the use of the Platform.
